The decision, delivered Friday, means the controversial octogenarian will remain detained as he faces charges of crimes against humanity, stemming from his alleged role in extrajudicial killings during his "war on drugs." This saga has been unfolding for years, and it doesn't seem to be ending anytime soon.

Judge Luz del Carmen Ibáñez Carranza, addressing the courtroom, stated that Duterte's lawyers had failed to demonstrate that a previous ruling by a lower chamber was unreasonable. Duterte himself, as has been typical, was not present at the hearing. The core of the ICC's case rests on the allegation that Duterte, during his time as both mayor of Davao City and later as president, instructed and authorized "violent acts including murder to be committed against alleged criminals, including alleged drug dealers and users." These charges cover a period from November 1, 2011, to March 16, 2019, the date the Philippines officially withdrew from the ICC.

The numbers are staggering. While official police figures place the death toll from Duterte's drug war at over 6,000, human rights organizations estimate the actual number could be as high as 30,000. The arrest of Duterte back in March was met with jubilation by many families who lost loved ones during the brutal crackdown. It’s hard to imagine the emotional weight this case carries for them.

Duterte’s legal team has argued that he is “infirm and debilitated,” claiming his continued detention is a form of cruel and unusual punishment. They even requested he be transferred to the custody of another member state while the trial proceeds, citing a decline in his cognitive abilities that allegedly hinders his ability to assist in his own defense. A pretrial hearing was postponed back in September to allow for a full medical assessment. I've seen similar tactics used in other high-profile cases, and it always raises questions about the defendant’s fitness to stand trial.

Despite these arguments, the appeals judges sided with the lower chamber, asserting that the risk posed by Duterte's release "could not be mitigated" by the unnamed country proposed by the defense. They also recently rejected a challenge to the court's jurisdiction in the case – another setback for Duterte’s lawyers. It seems the ICC is determined to pursue this case to its conclusion, regardless of the political complexities.

The ICC's investigation into Duterte began in February 2018, but the Philippines’ subsequent withdrawal from the court, a move widely seen as an attempt to evade accountability, has complicated matters. However, judges have emphasized that countries cannot use withdrawal as a shield from justice for alleged crimes already under consideration. This point is also being appealed by Duterte’s legal team, showing that the legal battles are far from over. The wheels of international justice turn slowly, but they do seem to be grinding forward in this case.
