The Supreme Court just delivered a significant blow to Donald Trump's economic playbook, ruling that his sweeping global tariffs imposed under the guise of national emergency powers were unconstitutional. In a 6-3 decision that reverberated through business and political circles Friday, the court essentially said: “You can’t do that.” Seems pretty clear cut, right?

At the heart of the matter was Trump's invocation of the 1977 International Emergency Economic Powers Act (IEEPA). He initially used it to justify tariffs against Canada, China, and Mexico, citing, incredibly, drug trafficking as a national emergency. Then, he extended the tariffs to nearly every country in the world, arguing that trade deficits constituted an "extraordinary and unusual threat." The Supreme Court, however, wasn't buying it. Chief Justice John Roberts, writing for the majority, stated plainly that the power to "regulate… importation" under IEEPA simply doesn't encompass the power to impose tariffs. It's Congress, according to the Constitution, that holds the authority to set taxes and tariffs.

The ruling was met with cheers from the US Chamber of Commerce, who called it “welcome news for businesses and consumers.” It's hard to argue with that sentiment. Think about the ripple effect of tariffs – increased costs for businesses, potentially passed on to consumers, and strained international relations. Bernd Lange, chairman of the European Parliament’s international trade committee, also chimed in, calling the decision a “positive signal for the rule of law." A win for international trade and potentially for global cooperation.

Of course, the dissenting justices, Kavanaugh, Alito, and Thomas, saw it differently. Kavanaugh argued that tariffs are indeed a traditional tool for regulating importation, and that the ruling would create "serious practical consequences" for importers who've already paid up. He has a point; what happens to all that money now? However, the majority opinion prevailed. It is interesting to note, that according to Monica Crowley, President Trump's chief of protocol, "President Trump has plenty of tools in the tariff toolbox." So, while this specific avenue has been shut down, it doesn’t sound like Trump's tariff ambitions are necessarily dead.

Ultimately, this Supreme Court decision underscores the limits of executive power, even in times of perceived crisis. It's a reminder that checks and balances still exist, and that even a president with a strong vision must operate within the bounds of the Constitution. How this ruling will impact future trade policy remains to be seen. But one thing is certain: the debate over tariffs and their role in the global economy is far from over.
